UNICAMERAL UPDATE:
LB943 was introduced into the Unicameral by Senator Myron Dorn on January 9, 2026. This bill would provide immunity from public or private nuisance claims against existing racing tracks and related facilities. The bill has been referred to the Judicial Committee for review. NRCA supports this Bill and would recommend that all NRCA members contact their District representative and ask them to support LB943 as well. Members of the Judicial committee should also be asked to give support to this bill. Summary of LB943: This bill provides immunity from public or private nuisance claims for motor vehicle racing facilities, defining such a facility as a location and its related structures like racetracks, garages, and spectator areas where vehicles are used for racing or practice. The bill states that a facility will not be considered a nuisance if it existed before a change in surrounding land use and was not a nuisance at that time, and it also establishes a two-year statute of limitations for bringing nuisance claims against these facilities, starting from when the issue becomes offensive enough to warrant a claim.
Iowa and North Carolina have recently passed similar safe-guard legislation for race facilities, and it is being considered in Oklahoma, Indiana, Kansas and Ohio. Many long standing race tracks have been forced to close or relocate due to urban development. Please contact your State Representative and voice your SUPPORT of LB943. Thank you.
